1.2relating to natural resources; permitting the use of muffler cutouts and bypasses
1.3in certain circumstances;amending Minnesota Statutes 2012, section 86B.521,
1.4subdivision 1.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 86B.521, subdivision 1, is amended to read:
1.7    Subdivision 1. Exhaust muffling system required. (a) A motor may not be used on
1.8a motorboat unless it is equipped with an efficient muffler, underwater exhaust, or other
1.9device that adequately muffles or suppresses the sound of the exhaust of the motor so as
1.10to prevent excessive or unusual noise. Except as provided under paragraph (b), a motor
1.11may not be equipped with an altered muffler, muffler cutout, muffler bypass, or any other
1.12device designed or installed so that it can be used to continually or intermittently bypass
1.13any muffler or muffler system installed in the motorboat or to reduce or eliminate the
1.14effectiveness of such a muffler or muffler system.
1.15(b) A motor used on a motorboat may be equipped with a muffler cutout or muffler
1.16bypass if the motor is incapable of exceeding the noise limits established under section
1.1786B.321, subdivision 2, at all levels of operation.
