1.1A bill for an act
1.2relating to liquor; authorizing a microdistillery to sell its own products at on-sale;
1.3amending Minnesota Statutes 2012, section 340A.301, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 340A.301, is amended by adding a
1.6subdivision to read:
1.7    Subd. 6d. Microdistillery hospitality room license. (a) A municipality may
1.8issue the holder of a microdistillery license a microdistillery hospitality room license. A
1.9microdistillery hospitality room license authorizes on-sale of distilled spirits produced by
1.10the microdistillery for consumption on the premises of or adjacent to one microdistillery
1.11location owned by the microdistillery. Nothing in this subdivision precludes the holder
1.12of a microdistillery hospitality room license from also holding a license to operate
1.13a restaurant at the microdistillery. Section 340A.409 shall apply to a license issued
1.14under this subdivision. All provisions of this chapter that apply to a retail liquor license
1.15shall apply to a license issued under this subdivision unless the provision is explicitly
1.16inconsistent with this subdivision.
1.17(b) A microdistiller may have only one microdistillery hospitality room license
1.18under this subdivision.
1.19(c) The municipality shall impose a licensing fee on a microdistillery holding a
1.20microdistillery hospitality room license under this subdivision, subject to limitations
1.21applicable to license fees under section 340A.408, subdivision 2, paragraph (a).
1.22(d) A municipality shall, within ten days of the issuance of a license under this
1.23subdivision, inform the commissioner of the licensee's name, address, and trade name,
1.24and the effective date and expiration date of the license. The municipality shall also
2.1inform the commissioner of a license transfer, cancellation, suspension, or revocation
2.2during the license period.
