1.2relating to natural resources; providing exemption for water-related service
1.3provider training; amending Minnesota Statutes 2012, section 84D.108,
1.4subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 84D.108, subdivision 2, is amended to read:
1.7    Subd. 2. Permit requirements. (a) Service providers must complete invasive
1.8species training provided by the commissioner and pass an examination to qualify for a
1.9permit. Service provider permits are valid for three calendar years.
1.10(b) A $50 application and testing fee is required for service provider permit
1.11applications.
1.12(c) Persons working for a permittee must satisfactorily complete aquatic invasive
1.13species-related training provided by the commissioner, except as provided under
1.14paragraph (d).
1.15(d) A person working for a permittee that is a resort need not complete the training
1.16under paragraph (c) if the water-related equipment or structures removed or installed
1.17by the person remains on property owned by the resort. A permittee is responsible for
1.18the direct supervision of a person engaged under this paragraph. For purposes of this
1.19paragraph, "resort" has the meaning given under section 157.15.
