1.1A bill for an act
1.2relating to public safety; requiring school officials to report violent offenses to
1.3the local law enforcement agency;proposing coding for new law in Minnesota
1.4Statutes, chapter 626.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [626.5534] SCHOOL OFFICIAL REPORTING OF VIOLENT
1.7OFFENSES.
1.8    Subdivision 1. Definitions. (a) As used in this section, the following terms have
1.9the meanings given them.
1.10(b) "Crime of violence" has the meaning given in section 624.712, subdivision 5.
1.11(c) "School official" means superintendents, principals, and professional employees
1.12who devote 50 percent or more of their time to administrative or supervisory duties over
1.13other personnel, and includes athletic coaches.
1.14(d) "School property" means:
1.15(1) a public or private elementary, middle, or secondary school building and its
1.16improved grounds, whether leased or owned by the school;
1.17(2) the area within a school bus when that bus is being used by a school to
1.18transport one or more elementary, middle, or secondary school students to and from
1.19school-related activities, including curricular, cocurricular, noncurricular, extracurricular,
1.20and supplementary activities; and
1.21(3) that portion of a building or facility under the temporary, exclusive control of a
1.22public or private school, a school district, or an association of such entities.
2.1    Subd. 2. School officials required to report. A school official shall immediately
2.2report to the local police department or county sheriff all substantiated allegations of a
2.3crime of violence involving a student and occurring on school property.
2.4    Subd. 3. Immunity from liability. Any person reporting in good faith and
2.5exercising due care shall have immunity from any civil or criminal liability that otherwise
2.6might result by reason of the person's actions pursuant to this section. No cause of action
2.7may be brought against any person for not making a report pursuant to this section.
