1.1A bill for an act
1.2relating to natural resources; lowering the maximum fee for an aquatic plant
1.3management permit; requiring rulemaking;amending Minnesota Statutes 2012,
1.4section 103G.615, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 103G.615, subdivision 2, is amended to
1.7read:
1.8    Subd. 2. Fees. (a) The commissioner shall establish a fee schedule for permits to
1.9control or harvest aquatic plants other than wild rice. The fees must be set by rule, and
1.10section 16A.1283 does not apply, but the rule must not take effect until 45 legislative days
1.11after it has been reported to the legislature. The fees shall not exceed $2,500 $750 per
1.12permit and shall be based upon the cost of receiving, processing, analyzing, and issuing
1.13the permit, and additional costs incurred after the application to inspect and monitor
1.14the activities authorized by the permit, and enforce aquatic plant management rules and
1.15permit requirements.
1.16    (b) A fee for a permit for the control of rooted aquatic vegetation for each contiguous
1.17parcel of shoreline owned by an owner may be charged. This fee may not be charged for
1.18permits issued in connection with purple loosestrife control or lakewide Eurasian water
1.19milfoil control programs.
1.20    (c) A fee may not be charged to the state or a federal governmental agency applying
1.21for a permit.
1.22    (d) A fee for a permit for the control of rooted aquatic vegetation in a public
1.23water basin that is 20 acres or less in size shall be one-half of the fee established under
1.24paragraph (a).
2.1(e) The money received for the permits under this subdivision shall be deposited in
2.2the treasury and credited to the water recreation account.
2.3(f) The fee for processing a notification to request authorization for work under a
2.4general permit is $30, until the commissioner establishes a fee by rule as provided under
2.5this subdivision.

2.6    Sec. 2. RULEMAKING; GOOD CAUSE EXEMPTION.
2.7The commissioner of natural resources must amend Minnesota Rules, part 6280.0450,
2.8to conform to section 1. The commissioner may use the good cause exemption under
2.9Minnesota Statutes, section 14.388, subdivision 1, clause (3), and Minnesota Statutes,
2.10section 14.386, does not apply except as provided in Minnesota Statutes, section 14.388.
