1.2relating to natural resources; providing an exception to public waters work
1.3permit requirements for certain road projects;amending Minnesota Statutes
1.42012, section 103G.245, subdivision 2.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 103G.245, subdivision 2, is amended to
1.7read:
1.8    Subd. 2. Exceptions. A public waters work permit is not required for:
1.9(1) work in altered natural watercourses that are part of drainage systems established
1.10under chapter 103D or 103E if the work in the waters is undertaken according to chapter
1.11103D or 103E;
1.12(2) a drainage project for a drainage system established under chapter 103E that does
1.13not substantially affect public waters; or
1.14(3) removal of debris, including logs that are at or near the water surface, dead
1.15trees and branches, and trash, that does not alter the original alignment, slope, or cross
1.16section of the waters; or
1.17(4) town road improvement and maintenance, including culvert restoration and
1.18replacement.
