1.1A bill for an act
1.2relating to public safety; requiring the state fire marshal to make the fire code
1.3available to the general public;amending Minnesota Statutes 2012, section
1.4326B.02, subdivision 6.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 326B.02, subdivision 6, is amended to read:
1.7    Subd. 6. State Fire Code rulemaking authority. (a) The commissioner of labor
1.8and industry, consistent with the recommendations of the state fire marshal, shall adopt
1.9a State Fire Code and make amendments thereto in accordance with the Administrative
1.10Procedure Act in chapter 14. The code and its amendments shall conform insofar as
1.11practicable to model fire codes generally accepted and in use throughout the United States,
1.12with consideration given to existing statewide specialty codes presently in use in the state
1.13of Minnesota. Statewide specialty codes and model codes with necessary modifications
1.14may be adopted by reference in accordance with section 14.07, subdivision 4.
1.15    (b) The state fire marshal must make paper copies of the state fire code, including
1.16amendments, available to the general public upon request. The fire marshal may charge
1.17a fee to a person requesting a copy of the fire code that does not exceed the cost to the
1.18state of providing the copy.
