1.1A bill for an act
1.2relating to environment; requiring Pollution Control Agency to refund erroneous
1.3assessments, costs, and payments in the matter of the Baytown groundwater
1.4contamination Superfund site.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. METROPOLITAN AIRPORTS COMMISSION PAYMENTS TO BE
1.7REFUNDED.
1.8(a) The commissioner of the Pollution Control Agency shall refund $3,569,499 to
1.9the Metropolitan Airports Commission for payments made and costs incurred by the
1.10Metropolitan Airports Commission from 1988 to 2009 in dealings with the Pollution
1.11Control Agency in the matter of 1,1,2-trichloroethene (TCE) contamination in the vicinity
1.12of the Lake Elmo Airport. The funds shall be deposited to the reliever airport account.
1.13(b) The Pollution Control Agency shall rescind the 1991 Request for Response
1.14Action made upon the Metropolitan Airports Commission and abate from the
1.15determination that the Metropolitan Airports Commission is a responsible party in the
1.16matter of the Baytown groundwater contamination Superfund site.
1.17EFFECTIVE DATE.This section is effective the day following final enactment.
