SUBSTITUTE FOR
SENATE BILL NO. 1279
A bill to amend 1956 PA 217, entitled
"Electrical administrative act,"
by amending section 7 (MCL 338.887), as amended by 2002 PA 205.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 7. (1) Except as otherwise provided in this act or in
subsection
(3), a person , firm, or corporation shall not engage in
the
business of electrical contracting unless the person ,
firm, or
corporation
has received from the board or from
the appropriate
municipality an electrical contractor's license.
(2) Except as otherwise provided in this act or in subsection
(3),
a person, other than a person licensed under this act and
employed
by and working under the direction of a holder of an
electrical
contractor's license, an
individual shall not in any
manner undertake to execute any electrical wiring unless he or she
meets all of the following:
(a) Is licensed under this act.
(b) Is employed by and working under the direction of a
licensed electrical contractor.
(3) A license under this act is not required in the execution
of the following classes of work:
(a)
Minor repair work. , as defined in section 1.
(b) The installation, alteration, repairing, rebuilding, or
remodeling of elevators, dumbwaiters, escalators, or man lifts
performed under a permit issued by an elevator inspection agency of
the
state of Michigan or this
state or a political subdivision of
the
this state. of Michigan.
(c) The installation, alteration, or repair of electrical
equipment and its associated wiring that is installed on the
premises
of consumers or subscribers a
consumer or subscriber by or
for
an electrical energy supply or communication agencies agency
for
use by such agencies that
agency in the generation,
transmission, distribution, or metering of electrical energy or for
the operation of signals or transmission of intelligence.
(d) The installation, alteration, or repair of electric wiring
for the generation and primary distribution of electric current, or
the secondary distribution system up to and including the meters,
where
such if that work is an integral part of the system owned and
operated
by an electric light and power utility in rendering
providing its duly authorized service.
(e) Any work involved in the manufacture of electric
equipment,
including the testing and repairing of such that
manufactured equipment.
(f) The installation, alteration, or repair of equipment and
its associated wiring for the generation or distribution of
electric energy for the operation of signals or transmission of
intelligence
where such if that work is in connection with a
communication system owned or operated by a telephone or telegraph
company in rendering its authorized service as a telephone or
telegraph company.
(g) Any installation, alteration, or repair of electrical
equipment
by a homeowner in a single family home, and or
in an
accompanying
outbuildings outbuilding, owned and occupied or to be
occupied
by the person individual who
is performing the
installation, alteration, or repair of electrical equipment.
(h) Any work involved in the use, maintenance, operation,
dismantling,
or reassembling of motion picture and or theatrical
equipment
used in any building with that
has approved facilities
for
entertainment or educational use and which has the necessary
permanent wiring and floor and wall receptacle outlets designed for
the
proper and safe use of such theatrical that equipment, but not
including any permanent wiring.
(i)
Work performed by a mechanical contractors contractor
licensed
in any of the classifications listed described in section
6(3)(a), (b), (d), (e), and (f) of the Forbes mechanical
contractors
act, 1984 PA 192, MCL 338.976, plumbing contractors
licensed
under 1929 PA 266, MCL 338.901 to 338.917, and employees
of
persons licensed under those acts a
plumbing contractor licensed
under the state plumbing act, 2002 PA 733, MCL 338.3511 to
338.3569, or an employee of a mechanical contractor or plumbing
contractor licensed under 1 of those acts, while performing
maintenance, service, repair, replacement, alteration,
modification, reconstruction, or upgrading of control wiring
circuits
and electrical component parts within in existing
mechanical systems defined in the mechanical and plumbing codes
provided
for in promulgated under the Stille-DeRossett-Hale single
state
construction code act, 1972 PA 230, MCL 125.1501 to 125.1531,
including, but not limited to, energy management systems, relays
and controls on boilers, water heaters, furnaces, air conditioning
compressors and condensers, fan controls, thermostats and sensors,
and all interconnecting wiring associated with the mechanical
systems
in buildings which that are on the load side of the unit
disconnect, which is located on or immediately adjacent to the
equipment, except for life safety systems wiring.
(j) Electrical wiring associated with the installation,
removal, alteration, or repair of a water well pump on a single
family dwelling to the first point of attachment in the house from
the
well, by a registered pump installer registered under part 127
of the public health code, 1978 PA 368, MCL 333.12701 to 333.12771.
(k) The installation, maintenance, or servicing of burglar
alarm
systems within in a building or structure.
(l) The installation, maintenance, or servicing of listed
residential and commercial lawn irrigation equipment, except any
permanent
wired connections exceeding that
exceed 30 volts.
(m) The installation, maintenance, or servicing of listed
landscape lighting systems and equipment, except any permanent
wired
connections exceeding that
exceed 30 volts.
(n) The installation, alteration, maintenance, or repair of
electric signs and related wiring by an unlicensed individual under
the direct supervision of a licensed sign specialist except that
the ratio of unlicensed individuals engaged in this activity shall
not exceed 2 unlicensed individuals to 1 licensed sign specialist.
An enforcing agency shall enforce this ratio on a jobsite basis.
(o)
The construction, installation, maintenance, repair, and
or renovation of telecommunications equipment and related systems
by
a person , firm, or corporation that is primarily
engaged in the
telecommunications and related information systems industry. This
exemption does not include the construction, installation,
maintenance,
repair, and or renovation of a fire alarm system.
(p) The installation, alteration, maintenance, repair, or
renovation of electrical wiring, at or in a property, business
location, plant, factory, or facility, of a person that is engaged
in manufacturing or mining operations by an employee or agent of
that person, if all of the following are met:
(i) The person employs or engages a licensed electrician who
the person designates as responsible for code compliance at the
property, business location, plant, factory, or facility and who is
authorized and responsible for obtaining any permits required for
any installation, alteration, maintenance, repair, or renovation of
electrical wiring at or in the property, business location, plant,
factory, or facility.
(ii) The person notifies the department in writing of the
identity of the licensed electrician designated as responsible for
code compliance under subparagraph (i).
(q) The installation, alteration, maintenance, or repair of
equipment and its associated wiring for the generation or
distribution of electricity at a facility owned and operated by an
independent power producer by an employee or agent of that
independent power producer. As used in this subdivision,
"independent power producer" means a person, other than an electric
utility, that owns or operates a facility that generates
electricity and sells electricity primarily at wholesale.
(4) All of the following apply for purposes of subsection
(3)(p):
(a) The written notice required under subsection (3)(p)(ii)
shall include the name, phone number, business address, and
signature of the licensed electrician and the name, phone number,
business address, and signature of the person that is engaged in
manufacturing or mining operations or the individual authorized to
sign on that person's behalf.
(b) If the person that is engaged in manufacturing or mining
operations designates a different licensed electrician as
responsible for code compliance for purposes of subsection
(3)(p)(i), the person shall notify the department. The written
notice shall include the same information and signatures described
in subdivision (a).
(c) If a person engaged in manufacturing or mining operations
has designated a licensed electrician as responsible for code
compliance under subsection (3)(p)(i) or subdivision (b), and that
licensed electrician ceases to be responsible for code compliance
on behalf of the person, the licensed electrician or the person
shall notify the department in writing within 60 days.
(d) The department shall retain a copy of each notice it
receives under subsection (3)(p)(ii) or subdivision (b) or (c) in
its records.
(5) As used in this act:
(a) "Licensed electrician" means a licensed electrical
contractor, electrical journeyman, or master electrician.
(b) "Person" means an individual, partnership, association,
corporation, limited liability company, or other legal entity.
