SENATE BILL No. 818

 

 

February 13, 2018, Introduced by Senators JONES, COLBECK and ANANICH and referred to the Committee on Government Operations.

 

 

     A bill to amend 1978 PA 472, entitled

 

"An act to regulate political activity; to regulate lobbyists,

lobbyist agents, and lobbying activities; to require registration

of lobbyists and lobbyist agents; to require the filing of reports;

to prescribe the powers and duties of the department of state; to

prescribe penalties; and to repeal certain acts and parts of acts,"

 

(MCL 4.411 to 4.431) by amending the title and by adding section

 

17a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

TITLE

 

     An act to regulate political activity; to regulate lobbyists,

 

lobbyist agents, and lobbying activities; to require registration

 

of lobbyists and lobbyist agents; to require the filing of reports;

 

to require certain individuals to disclose certain information; to

 


prescribe the powers and duties of the department of state; to

 

prescribe penalties; and to repeal certain acts and parts of acts.

 

     Sec. 17a. (1) If an individual who is appointed by the

 

governor to a governmental body is or was at any time in the 10

 

years immediately preceding the appointment a lobbyist or lobbyist

 

agent, the individual shall file a disclosure with the secretary of

 

state, on a form prescribed by the secretary of state, that

 

includes both of the following:

 

     (a) A statement that the individual is a lobbyist or lobbyist

 

agent or was at any time in the immediately preceding 10 years a

 

lobbyist or lobbyist agent, as applicable.

 

     (b) The name, address, and nature of business of every person

 

who gave compensation to or reimbursed the individual or

 

individual's representative for lobbying.

 

     (2) The secretary of state shall post on its website a

 

registry of the disclosures it receives under subsection (1).

 

     (3) An individual who violates subsection (1) is guilty of a

 

misdemeanor punishable by imprisonment for not more than 90 days or

 

a fine of not more than $500.00, or both.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
