A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
(MCL 257.1 to 257.923) by adding section 312k.
the people of the state of michigan enact:
Sec. 312k. (1) Beginning December 1, 2020, a person shall complete training on the recognition, prevention, and reporting of human trafficking as a condition to obtaining a commercial learner's permit for an original vehicle group designation or indorsement to operate a commercial motor vehicle, renewing an operator's or chauffeur's license to operate a commercial motor vehicle, or renewing a vehicle group designation or indorsement.
(2) A person who is applying for a permit, license, designation, or indorsement described under subsection (1) shall certify his or her compliance with subsection (1) to the secretary of state.
(3) The human trafficking commission shall recommend to the secretary of state minimum standards for the training required under subsection (1).
(4) The secretary of state shall promulgate rules under the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328, to establish the training requirements under subsection (1) and shall include the recommendations provided under subsection (3) in the training requirements.
(5) As used in this section:
(a) "Human trafficking" means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750.462a to 750.462h.
(b) "Human trafficking commission" means the human trafficking commission established under section 3 of the human trafficking commission act, 2014 PA 325, MCL 752.973.
Enacting section 1. This amendatory act does not take effect unless Senate Bill No. 772 of the 100th Legislature is enacted into law.
