SENATE BILL NO. 762

December 01, 2021, Introduced by Senators SCHMIDT and MCBROOM and referred to the Committee on Agriculture.

A bill to amend 1919 PA 339, entitled

"Dog law of 1919,"

by amending section 2 (MCL 287.262).

the people of the state of michigan enact:

Sec. 2. (1) It A person shall be unlawful for any person to own not do any of the following:

(a) Own any dog 6 months old or over, unless the dog is licensed as hereinafter provided, or to own required under this act.

(b) Own any dog 6 months old or over that does not at all times wear a collar with a tag attached as required under this act and approved by the director of the department of agriculture , attached as hereinafter provided, except when and rural development, unless the dog is engaged in lawful hunting, sled dog racing, sled dog training, or sled dog camping, and accompanied by its owner or custodian. ; or for any owner of any

(c) Permit a female dog to permit the female dog to go beyond the owner's premises of such owner when she when the female dog is in heat, unless the female dog is held properly in leash. ; or for any person except the owner or authorized agent, to remove

(d) Remove any license tag from a dog, unless the owner or the owner's authorized agent removes the license tag. ; or for any owner to allow

(e) Allow any dog , except to stray unless either of the following applies:

(i) The dog is properly leashed and under the owner's or the owner's authorized agent's control.

(ii) The dog is a working dogs such as leader dogs, guard dogs, farm dogs, hunting dogs, and other such dogs, when dog that is accompanied by their its owner or his the owner's authorized agent , while and is actively engaged in activities for which such dogs are trained, to stray unless held properly in leash.the dog is trained.

(2) As used in this section, "working dog" means a dog that is trained as a leader dog, guard dog, farm dog, hunting dog, sled dog, or another similar activity.
