SENATE BILL No. 738

 

 

December 13, 2017, Introduced by Senators PROOS, HERTEL and KNEZEK and referred to the Committee on Local Government.

 

 

     A bill to amend 1917 PA 19, entitled

 

"An act to authorize and empower the public domain commission to

issue certificates of correction in certain cases, and to have the

same recorded in the office of the register of deeds in any county

wherein the lands affected by such certificate may be located,"

 

by amending section 1 (MCL 322.381).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. Whenever it shall appear that a deed has been If the

 

department of natural resources has executed and issued by the

 

public domain commission, purporting a deed that purports to convey

 

title to lands in which the this state of Michigan held no

 

interest, and such the deed has been recorded in the office of the

 

register of deeds for the county in which such the lands are

 

located, and, when in the an attempt to correct such the erroneous

 

sale and transfer, a deed has been executed to this state by the

 

grantee of the state to the state of Michigan, such deed original


deed, the department of natural resources shall be placed on record

 

the corrective deed in the office of such the register of deeds. ,

public domain commission department of natural resources shall

 

execute issue a certificate wherein it shall be stated stating that

 

the this state of Michigan has and claims no title in or to the

 

lands described in such the corrective deed to the state of

 

Michigan, and that such the certificate is issued for the express

 

purpose of removing to remove any cloud upon on the title in to the

 

lands described in such deed by reason of that may have been caused

 

by the original deed issued by the state of Michigan in the first

 

place, or by the corrective deed. so received from the grantee.

 

Such certificate shall be issued under the seal of the public

 

domain commission and shall be placed on record by such The

 

register of deeds , who shall at the same time enter in the record

 

of deeds herein referred to a citation to the record of such the

 

certificate, of correction.and is entitled to the same fee as is

 

charged for recording a real estate mortgage under section 2567 of

 

the revised judicature act of 1961, 1961 PA 236, MCL 600.2567.

 

     Enacting section 2. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
