SENATE BILL NO. 525

A bill to amend 1966 PA 293, entitled

"An act to provide for the establishment of charter counties; to provide for the election of charter commissioners; to prescribe their powers and duties; to prohibit certain acts of a county board of commissioners after the approval of the election of a charter commission; to prescribe the mandatory and permissive provisions of a charter; to provide for the exercise by a charter county of certain powers whether or not authorized by its charter; and to prescribe penalties and provide remedies,"

(MCL 45.501 to 45.521) by adding section 14b.

the people of the state of michigan enact:

Sec. 14b. (1) Notwithstanding any charter provision to the contrary and except as otherwise provided in subsection (2), if a county with a population of less than 1,000,000 elects a county executive under this act, both of the following apply:

(a) At the general November election in 2022, a county executive who is a qualified elector in that county shall be elected at large on a partisan basis for a term of 2 years beginning on January 1, 2023 and ending on December 31, 2024.

(b) At the general November election in 2024 and every fourth year after 2024, a county executive who is a qualified elector in that county shall be elected at large on a partisan basis for a term of 4 years beginning on January 1 following the election.

(2) If, by April 1, 2022, a board of county commissioners in a county with a population of less than 1,000,000 adopts a resolution to continue to elect the county executive of that county at large on a partisan basis for a term of 4 years concurrent with the term of office of the governor, then the county executive of that county shall continue to be elected at large on a partisan basis for a term of 4 years concurrent with the term of office of the governor.
