SENATE BILL No. 487

 

 

September 10, 2015, Introduced by Senators BOOHER, PROOS, HANSEN, KNEZEK, SCHUITMAKER and HORN and referred to the Committee on Judiciary.

 

 

 

     A bill to amend 1953 PA 232, entitled

 

"Corrections code of 1953,"

 

(MCL 791.201 to 791.285) by adding section 69b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 69b. (1) A person who is operating an unmanned aerial

 

vehicle shall not fly the aircraft or device within 1,000 feet of

 

any correctional facility in this state.

 

     (2) This section does not apply to a law enforcement agency

 

operating an unmanned aerial vehicle under Federal Aviation

 

Administration regulations.

 

     (3) A person who violates this section is guilty of a felony

 

punishable by imprisonment for not more than 4 years or a fine of

 

not more than $2,000.00, or both.

 

     (4) As used in this section:

 


     (a) "Correctional facility" includes a facility or institution

 

that is maintained and operated by the department of corrections

 

and a facility or institution operated by a private entity under

 

section 20i of the corrections code of 1953, 1953 PA 232, MCL

 

791.220i.

 

     (b) "Law enforcement agency" means the department of state

 

police, the department of natural resources, or a law enforcement

 

agency of a county, township, city, or village that is responsible

 

for the prevention and detection of crime and enforcement of the

 

criminal laws of this state.

 

     (c) "Unmanned aerial vehicle" means an unmanned vehicle or

 

device that uses aerodynamic forces to achieve flight and is

 

piloted remotely.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
