SENATE BILL NO. 369

April 21, 2021, Introduced by Senators GEISS, WOJNO, POLEHANKI and BULLOCK and referred to the Committee on Education and Career Readiness.

A bill to amend 1976 PA 451, entitled

"The revised school code,"

(MCL 380.1 to 380.1852) by adding section 1160.

the people of the state of michigan enact:

Sec. 1160. (1) Beginning with the 2021-2022 school year, the board of a school district or board of directors of a public school academy that operates an elementary school shall ensure that the school district or public school academy meets all of the following with respect to the provision of art and music in its curriculum:

(a) Provides for all pupils in grades K to 5 at least 90 minutes per week of instruction in music, taught by a certificated teacher with a JX or JQ endorsement issued by the department.

(b) Provides for all pupils in grades K to 5 at least 90 minutes per week of instruction in art, taught by a certificated teacher with an LX, LQ, or LZ endorsement issued by the department.

(c) Maintains staffing that includes at least 1 certificated teacher with a JX or JQ endorsement issued by the department for every 400 pupils enrolled in grades K to 5.

(d) Maintains staffing that includes at least 1 certificated teacher with an LX, LQ, or LZ endorsement issued by the department for every 650 pupils enrolled in grades K to 5.

(e) Adopts and implements specific curricula for music and art.

(f) Maintains in each elementary school at least 1 space that is designated for music instruction and allows for effective implementation of the music curriculum, with consideration given to the physical materials and tools needed for music instruction.

(g) Maintains in each elementary school at least 1 space that is designated for visual art instruction and allows for effective implementation of the visual arts curriculum, with consideration given to the physical materials and tools needed for art instruction.

(h) Establishes and maintains a separate dedicated budget for music instruction and art instruction in grades K to 5.

(2) The legislature shall provide for funding to school districts and public school academies for any increase in costs related to compliance with this section.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
