Sec. 201. Pursuant to section 30 of article IX of the state constitution of 1963, total state spending from state sources under part 1 for the fiscal year ending September 30, 2023 is $1,000,000,000.00 and total state spending from state sources to be paid to local units of government is $677,445,000.00.

under this part and part 1 are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

 

DEPARTMENT OF THE ATTORNEY GENERAL

Sec. 301. (1) From the funds appropriated in part 1 for county prosecutor grants, the attorney general shall allocate $200,000,000.00 for grants to the offices of each eligible county prosecutor. Grant amounts shall be determined based on the population of the county for which an eligible county prosecutor serves as a percentage of the total population of all counties for which an eligible county prosecutor serves. The attorney general must use data from the most recent federal decennial census for the purposes of determining the population of each county under this subsection.

(2) Grants issued under this section must be used by a county prosecutor to reduce the average caseload per attorney to facilitate stronger prosecution of firearm-related crimes.

(3) To be eligible for a grant under this section, a county prosecutor's office must demonstrate that it has maintained the same level of local funding from the county throughout that county's current fiscal year as budgeted by that county's board of commissioners.

(4) By September 30, 2023, a county prosecutor's office receiving a grant under this section must submit to the house and senate appropriations committees, the state budget director, and the house and senate fiscal agencies a report on the use of the grant. This report must include all of the following for the 12-month period between October 1, 2022, and September 30, 2023:

(a) The total number of staff in the prosecutor's office.

(b) The average caseload of each attorney in the prosecutor's office.

(c) The amount of local funding provided to the prosecutor's office.

(d) The number of firearm-related cases handled by the prosecutor's office.

(e) The number and percentage of firearm-related cases pleaded down from the original charge.

(f) The number and percentage of firearm-related cases where a firearm was seized from a defendant.

(g) The number and percentage of firearm-related cases that resulted in a conviction.

 

DEPARTMENT OF EDUCATION

Sec. 401. (1) Before issuing payments under section 402, from the funds appropriated in part 1 for school safety grants, the department of education shall issue a payment of $50.00 per pupil to each school district or nonpublic school for each pupil attending a school within that district that employs or contracts with a school resource officer.

(2) For the purposes of this section, a school resource officer is assumed to be employed or contracted with a school if the school resource officer regularly patrols that school, even if the officer is contracted with the school district rather than the school directly.

(3) Only school resource officers hired or contracted before the effective date of this act or within 90 days after the effective date of this act may be counted for the purposes of determining a payment amount under subsection (1).

(4) To receive funding under this section, school districts and nonpublic schools must apply for the funding in a form and manner prescribed by the department of education.

Sec. 402. (1) Subject to section 401, from the funds appropriated in part 1 for school safety grants, the department of education shall allocate any funds remaining following the payments issued under section 401 to provide payments to school districts and nonpublic schools for activities to improve student safety. Allowable expenditures of funds allocated under this section include, but are not limited to, the following:

(a) Coordination with local law enforcement.

(b) Training for school staff on threat assessment.

(c) Training for school staff and students on threat response.

(d) Training for school staff on crisis communication.

(e) Safety infrastructure, including, but not limited to, cameras, door blocks, hardened vestibules, window screening, and technology necessary to operate buzzer systems. This may also include firearm detection software that integrates to existing security cameras to detect and alert school personnel and first responders to visible firearms on school property.

(f) Age-appropriate training for students and families on responsible gun ownership.

(g) Providing professional development to school resource officers that includes training on the best practices for serving in a school setting.

(h) Any other school safety service or product necessary to improve or maintain security in buildings.

(2) The department of education shall make payments in an equal amount per pupil. For school districts, the payment shall be

based on the total number of pupils in membership in each school district. For nonpublic schools, the payment shall be made based on pupil counts as determined by the department of education.

(3) If funding remains after the distribution of funds described in subsection (2), the department of education may provide additional per-pupil allocations to allocate remaining funding, using for those calculations the same requirements described in subsection (2).

(4) To receive funding under this section, school districts and nonpublic schools must apply for the funding in a form and manner prescribed by the department of education.

 

DEPARTMENT OF LABOR AND ECONOMIC OPPORTUNITY

Sec. 501. From the funds appropriated in part 1 for community college and university safety grants, the department of labor and economic opportunity shall allocate $400,000,000.00 to the public universities and community colleges in this state. Payments shall be made in an equal amount per full-year equivalent student, based on the most recently available enrollment data collected through the higher education information data inventory or the center for educational performance and information, or both. Funds shall be used for safety infrastructure, including, but not limited to, cameras, door blocks, hardened vestibules, window screening, and technology necessary to operate alert systems and coordinate with local law enforcement. This may also include firearm detection software that integrates to existing security cameras to detect and alert school personnel and first responders to visible firearms on school property.

REPEALER

Sec. 601. Section 695 of the income tax act of 1967, 1967 PA 281, MCL 206.695, is repealed.
