SENATE BILL No. 109

 

 

February 7, 2017, Introduced by Senators WARREN and HUNE and referred to the Committee on Agriculture.

 

 

     A bill to amend 2006 PA 110, entitled

 

"Michigan zoning enabling act,"

 

(MCL 125.3101 to 125.3702) by adding section 205b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 205b. A local unit of government shall not adopt or

 

enforce provisions that regulate raising of livestock in urban and

 

suburban areas unless the zoning ordinance provisions meet both of

 

the following:

 

     (a) Are consistent with the guidelines established by the

 

commission of agriculture and rural development in section 4 of the

 

urban agriculture act.

 

     (b) Are consistent with the Michigan right to farm act, 1981

 

PA 93, MCL 286.471 to 286.474, and the generally accepted

 

agricultural and management practices adopted under that act.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. 108                                      

 

          of the 99th Legislature is enacted into law.
