Reps. Eisen, O'Malley, Paquette, Green, Berman, Steven Johnson, Meerman, LaFave, Markkanen, Wozniak, Bellino, Rendon, Lightner and Allor offered the following resolution:

A resolution to declare Michigan a Second Amendment sanctuary state and fully affirm its support of the rights ensured and protected by the constitutions of the United States and Michigan, including the rights of law-abiding citizens to keep and bear arms.

Whereas, The members of the Michigan House of Representatives have taken an oath to defend and uphold the constitutions of the United States and Michigan; and

Whereas, The Second Amendment to the Constitution of the United States reads:

A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

; and

Whereas, Article I, Section 6 of the Constitution of the State of Michigan of 1963 reads:

Every person has a right to keep and bear arms for the defense of himself and the state.

Whereas, The House is concerned that legislation pending in the Michigan Legislature and U.S. Congress, if passed, could infringe upon rights guaranteed by the Second Amendment to the Constitution of the United States and Article I, Section 6 of the Constitution of the State of Michigan of 1963; and

Whereas, Upholding the oath of office in Michigan requires public servants to refuse to participate in the enforcement of unconstitutional restrictions on the Second Amendment and attempt to defend individuals from unlawful enforcement of such restrictions; now, therefore, be it

Resolved by the House of Representatives, That we declare Michigan a Second Amendment sanctuary state and fully affirm its support of the rights ensured and protected by the constitutions of the United States and Michigan, including the rights of law-abiding citizens to keep and bear arms; and be it further

Resolved, That we urge the United States Congress as well as state and federal agencies to vigilantly preserve and protect those rights by rejecting any provision, law, or regulation that may infringe, have the tendency to infringe, or place any additional burdens on the right of law-abiding citizens to keep and bear arms; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.
