A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending the heading of part 163 and section 16301 (MCL
324.16301) and by adding sections 16302a and 16302b.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
PART 163. PLASTIC DEGRADABLE CONTAINERS PLASTICS
Sec. 16301. As used in this part:
(a) "Containers" means glass, metal, or plastic bottles, cans,
jars, or other receptacles that contain any substance.
(b) "Degradable" means capable of being broken down by
biodegradation, photodegradation, or chemical degradation into
component parts within 360 days under exposure to the elements.
(c) "Single-use plastic item" means a disposable item that is
made substantially of plastic and designed to be used only once.
Single-use plastic item includes, but is not limited to, any of the
following items:
(i) Cotton swabs.
(ii) Cutlery.
(iii) Plates.
(iv) Straws.
(v) Drink stirrers.
Sec. 16302a. (1) Beginning 5 years after the effective date of
the amendatory act that added this section, except as provided in
subsection (2), a person shall not sell or offer for sale in this
state a single-use plastic item that is not degradable.
(2) Subsection (1) does not apply if there is no available
sustainable alternative for a single-use plastic item that is not
degradable.
Sec. 16302b. Not later than 1 year after the effective date of
the amendatory act that added this section, the department shall
promulgate rules setting forth standards for determining if a
sustainable alternative is available for purposes of section
16302a.
