A bill to amend 1956 PA 218, entitled
"The insurance code of 1956,"
(MCL 500.100 to 500.8302) by adding section 3107c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3107c. (1) An automobile insurer shall pay for services
covered under section 3107(1)(a) that are provided by a home health
agency to an injured person if all of the following are met:
(a) The services are ordered by a health professional acting
within the scope of his or her license or certificate.
(b) The services are provided to the injured person in his or
her home other than a hospital, nursing home, or county medical
care facility.
(c) The home health agency is accredited by an accreditation
organization recognized and utilized by the federal Medicare
program for the purpose of granting eligibility for enrolled
Medicare providers, including, but not limited to, the Community
Health Accreditation Program, the Joint Commission, the
Accreditation Commission for Health Care, or another accrediting
organization with substantially equivalent standards to those
programs as certified by the director.
(2) This section does not apply to services covered under
section 3107(1)(a) that are not provided by a home health agency.
(3) As used in this section:
(a) "County medical care facility" means that term as defined
in section 20104 of the public health code, 1978 PA 368, MCL
333.20104.
(b) "Health professional" means that term as defined in
section 5883 of the public health code, 1978 PA 368, MCL 333.5883.
(c) "Home health agency" means a person whose business is to
provide to individuals in their places of residence other than a
hospital, nursing home, or county medical care facility 1 or more
of the following services:
(i) Nursing services.
(ii) Therapeutic services.
(iii) Social work services.
(iv) Home health aide services.
(v) Other services related to the services described in
subparagraphs (i) to (iv).
(d) "Hospital" means that term as defined in section 20106 of
the public health code, 1978 PA 368, MCL 333.20106.
(e) "Nursing home" means that term as defined in section 20109
of the public health code, 1978 PA 368, MCL 333.20109.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
