HOUSE BILL NO. 6279

June 23, 2022, Introduced by Reps. Haadsma and Lasinski and referred to the Committee on Education.

A bill to amend 1979 PA 94, entitled

"The state school aid act of 1979,"

by amending section 11 (MCL 388.1611), as amended by 2022 PA 93 and by adding sections 23f and 23g.

the people of the state of michigan enact:

Sec. 11. (1) For the fiscal year ending September 30, 2022, there is appropriated for the public schools of this state and certain other state purposes relating to education the sum of $14,821,340,700.00 $15,106,340,700.00 from the state school aid fund, the sum of $97,619,400.00 $97,619,400.00 from the general fund, an amount not to exceed $72,000,000.00 from the community district education trust fund created under section 12 of the Michigan trust fund act, 2000 PA 489, MCL 12.262, and an amount not to exceed $100.00 from the water emergency reserve fund. In addition, all available federal funds are only appropriated as allocated in this article for the fiscal year ending September 30, 2022.

(2) The appropriations under this section are allocated as provided in this article. Money appropriated under this section from the general fund must be expended to fund the purposes of this article before the expenditure of money appropriated under this section from the state school aid fund.

(3) Any general fund allocations under this article that are not expended by the end of the fiscal year are transferred to the school aid stabilization fund created under section 11a.

Sec. 23f. (1) From the state school aid fund money appropriated in section 11, there is allocated for 2021-2022 an amount not to exceed $280,000,000.00 for payments to eligible districts for implementing a Michigan kids back on track program as prescribed in this section.

(2) To receive money under this section, a district must do all of the following:

(a) Apply for the money in a form and manner prescribed by the department.

(b) Post a Michigan kids back on track plan on the homepage of its website that describes evidence-based actions it is taking to respond to student needs related to unfinished learning and how the money under this section could create or expand those efforts. The plan described in this subdivision must meet, at a minimum, all of the following criteria:

(i) Reflect the input of educators, parents, legal guardians, and community members.

(ii) Include an analysis of student data and described student needs.

(iii) Identify evidence-based best practices to be implemented or expanded in response to student needs.

(c) Implement and maintain functionality on the homepage of its website that allows parents, legal guardians, and students to request additional assistance through a Michigan kids back on track program.

(d) Match at least 100% of the funding received under this section with funds from other sources and use those funds for the implementation of a Michigan kids back on track program.

(3) If a district does not match at least 100% of funding received under this section with other available funds, the district must return any unmatched funds to the department on a timeline determined by the department. The department may redistribute any returned funds to districts eligible to receive funds under this section on an equal per pupil basis. Districts receiving redistributed dollars must increase expenditures from other sources to match the amount of redistributed dollars received under this section.

(4) The department shall pay an equal amount per membership pupil to each district eligible to receive funds under this section.

(5) Districts shall use money received under this section for a Michigan kids back on track program and may use money received under this section for staffing costs, curriculum needs, student transportation needs, or other costs incurred as a result of providing services through a Michigan kids back on track program as described in this section.

(6) The superintendent of public instruction shall provide guidelines to districts on evidence-based best practices and effective strategies a district may use to respond to unfinished learning and shall provide resources to assist districts in implementing evidence-based programs.

(7) As used in this section, the "Michigan kids back on track program" means programs for students in any or all of grades pre-K through 12 that are designed to address unfinished learning, get students to grade-level academic standards, provide additional academic assistance to students at risk of falling behind their peers, and help high school students prepare for postsecondary education. Programs described in this subsection may be provided before school, during school, or after school and may be provided directly by the district or in partnership with community-based organizations.

(8) The funds allocated under this section for 2021-2022 are a work project appropriation, and any unexpended funds for 2021-2022 are carried forward into 2022-2023. The purpose of the work project is to address unfinished learning. The estimated completion date of the work project is September 30, 2024.

(9) Notwithstanding section 17b, the department shall make payments under this section on a schedule determined by the department.

Sec. 23g. (1) From the state school aid fund money appropriated in section 11, there is allocated for 2021-2022 an amount not to exceed $5,000,000.00 to eligible districts for coverage of costs associated with criminal history checks described in section 1230 of the revised school code, MCL 380.1230, or costs associated with criminal records checks described in section 1230a of the revised school code, MCL 380.1230a, accrued in the onboarding of new staff members for the implementation of a Michigan kids back on track program described in section 23f.

(2) Subject to subsection (4), to receive money under this section, a district must apply for the money in a form and manner prescribed by the department.

(3) A district that received money under section 23f is an eligible district under this section.

(4) On a timeline determined by the department, districts applying for money under this section shall notify the department of the number of new staff that required criminal history checks or criminal records checks as described in subsection (1) in the implementation of a Michigan kids back on track program under section 23f.

(5) The department shall pay each applicant eligible district an equal amount per new staff member described in subsection (4).

(6) Eligible districts that receive money under this section cannot charge new staff described in subsection (4) for required criminal history checks or criminal records checks as described in subsection (1).

(7) The funds allocated under this section for 2021-2022 are a work project appropriation, and any unexpended funds for 2021-2022 are carried forward into 2022-2023. The purpose of the work project is to reimburse districts for costs, as described in this section, associated with new staff members hired for the implementation of a Michigan kids back on track program under section 23f. The estimated completion date of the work project is September 30, 2024.

(8) Notwithstanding section 17b, the department shall make payments under this section on a schedule determined by the department.
