HOUSE BILL NO. 6169

A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

by amending section 552b (MCL 750.552b), as added by 1996 PA 232.

the people of the state of michigan enact:

Sec. 552b. (1) A person who willfully trespasses by entering or remaining upon on the property of a state correctional facility without authority or permission to enter or remain is guilty of a felony punishable by imprisonment for not more than 4 years or a fine of not more than $2,000.00, or both.

(2) As used in this section, "state correctional facility" means a facility or institution that houses a prisoner population under the jurisdiction of the department of corrections or that is operated by a private contractor under section 20i of the corrections code of 1953, 1953 PA 232, MCL 791.220i, for the housing, custody, and care of detainees or inmates from a federal agency. State correctional facility does not include a community corrections center or a community residential home.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 6170 (request no. 07358'20) of the 100th Legislature is enacted into law.
