HOUSE BILL No. 6143

 

 

June 7, 2018, Introduced by Reps. Hammoud, Wittenberg, Moss, Sowerby, Clemente, LaGrand, Yancey, Santana, Zemke and Chang and referred to the Committee on Natural Resources.

 

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding section 5503b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5503b. Notwithstanding any other provision of this part,

 

in determining whether to issue a permit under this part, the

 

department shall consider whether emissions from the proposed

 

permitted facility would adversely affect public health in the

 

vicinity of the facility considering all other air pollution

 

emissions in the vicinity and ambient air quality.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
