A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding sections 21334 and 21737.
the people of the state of michigan enact:
Sec. 21334. (1) A home for the aged
shall make available to a resident of the home for the aged a mobile electronic
device to allow the resident to make and receive personal video calls.
(2)
For the purpose described in subsection (1), the department of health and human
services shall provide at least 2 mobile electronic devices immediately to each
home for the aged that is a COVID-19 regional hub and by October 1, 2020 to
each home for the aged that is not a COVID-19 regional hub.
(3)
If a home for the aged cannot meet the requirement of subsection (1), the home
for the aged may apply to the department for a waiver in a form and manner
required by the department. The department shall establish by rule the
requirements for obtaining a waiver under this subsection. In determining
whether to grant or deny a waiver under this subsection, the department shall
consider any technological limitation not within the control of the home for
the aged or any other exceptional circumstance.
(4)
As used in this section:
(a)
"COVID-19 regional hub" means a hub as designated by the department of
health and human services.
(b)
"Mobile electronic device" means a mobile device that is capable of
making and receiving video calls.
Sec. 21737. (1) A nursing home shall make
available to a resident a mobile electronic device to allow the resident to
make and receive personal video calls.
(2)
For the purpose described in subsection (1), the department of health and human
services shall provide at least 2 mobile electronic devices immediately to each
nursing home that is a COVID-19 regional hub and by October 1, 2020 to each nursing
home that is not a COVID-19 regional hub.
(3)

(4)
