HOUSE BILL NO. 6050

A bill to amend 1976 PA 451, entitled

"The revised school code,"

(MCL 380.1 to 380.1852) by adding section 1201a.

the people of the state of michigan enact:

Sec. 1201a. (1) Subject to subsections (2) and (3), the board of a school district or intermediate school district or board of directors of a public school academy shall audiorecord each meeting of the board or board of directors and, not later than 2 business days following the meeting, shall make the full, unedited audiorecording of the meeting available to the public on its website homepage.

(2) This section does not limit any law requiring a greater degree of openness for a meeting of a board of a school district or intermediate school district or board of directors of a public school academy and does not prohibit the board of a school district or intermediate school district or board of directors of a public school academy from adopting a policy that provides for a greater degree of openness for its meetings.

(3) This section does not apply to a meeting of the board of a school district or intermediate school district or board of directors of a public school academy to the extent it is properly held in closed session under section 8 of the open meetings act, 1976 PA 267, MCL 15.268.

(4) This section does not apply to a unit of local government unless the legislature, if needed to comply with section 29 of article IX of the state constitution of 1963, appropriates sufficient funding to the unit of local government for any new or increased costs that would be incurred by that unit of local government in the implementation of this section.
