HOUSE BILL No. 5977

 

 

May 9, 2018, Introduced by Reps. Geiss, Love, Garrett and Clemente and referred to the Committee on Regulatory Reform.

 

     A bill to amend 2016 PA 62, entitled

 

"Human trafficking notification act,"

 

by amending sections 2 and 4 (MCL 752.1032 and 752.1034).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 2. As used in this act:

 

     (a) "Adult entertainment establishment" means either of the

 

following:

 

     (i) An adult entertainment establishment that holds a topless

 

activity permit under section 916(3) of the Michigan liquor control

 

code of 1998, 1998 PA 58, MCL 436.1916.

 

     (ii) Any other retail establishment that provides adult-

 

oriented entertainment in which performers disrobe or perform in an

 

unclothed state for entertainment.


     (b) "Department" means the department of licensing and

 

regulatory affairs.

 

     (c) "Human trafficking notice" means the notice described in

 

section 5.

 

     (d) "Locker room facilities" means the private locker room

 

facilities required under section 1486(1)(c) of the occupational

 

code, 1980 PA 299, MCL 339.1486.

 

     Sec. 4. (1) The human trafficking notice required under this

 

act shall must be posted in a conspicuous manner clearly visible to

 

the public and employees within each facility operated by an entity

 

described in section 3 that is open to use by the public.

 

     (2) In addition to the requirements under subsection (1), an

 

adult entertainment establishment shall post the human trafficking

 

notice required under this act in the locker room facilities at

 

that establishment.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No.____ or House Bill No 5976 (request no.

 

05627'18) of the 99th Legislature is enacted into law.
