A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 21517.

the people of the state of michigan enact:

Sec. 21517. (1) By January 1, 2021, a hospital that maintains a charge description master shall make its charge description master available to the public by conspicuously posting on the hospital's website an electronic copy of the charge description master and a description of each service, item, or service package listed on the charge description master. The hospital shall update the posting by January 1 of each succeeding year. If the hospital has no website, it shall make a written or electronic copy of its charge description master available at the hospital location. A hospital shall also post a clear and conspicuous notice in its emergency department, if any, admissions office, and billing office informing patients that the hospital's charge description master is available in the manner described in this subsection. A hospital shall post with its charge description master a notice that the standard charges listed on the charge description master may not reflect the actual charge that is billed to a patient and that a patient is responsible for understanding whether and to what extent a service, item, or service package is covered by his or her insurance provider.

(2) A hospital shall ensure that the standard charges included on its charge description master do not include any information that identifies or could be used to identify a third-party payer or a charge negotiated with a specific third-party payer.

(3) A hospital shall not enter into any contract that prevents it from making its charge description master available as required by this section.

(4) As used in this section:

(a) "Charge description master" means a list of standard charges for each service, item, and service package provided to a patient in connection with an inpatient or outpatient visit at the hospital.

(b) "Regular rate" includes, but is not limited to, the gross charge for a service, item, or service package.

(c) "Service package" means the aggregation of services or items into a single service with a single, standard charge.

(d) "Standard charge" means the regular rate established by the hospital for a service, item, or service package.
