HOUSE BILL NO. 5830

A bill to amend 1998 PA 58, entitled

"Michigan liquor control code of 1998,"

(MCL 436.1101 to 436.2303) by adding section 538.

the people of the state of michigan enact:

Sec. 538. An on-premises licensee that does not have written approval from the commission to have outdoor service in an outdoor service area under R 436.1419 of the Michigan Administrative Code may have outdoor service in an outdoor service area without the approval of the commission or the governing body of the local unit of government in which the licensed premises is located if the following conditions are met:

(a) The outdoor service area is adjacent to the licensed premises.

(b) The on-premises licensee owns the outdoor service area.

(c) The on-premises licensee ensures that the outdoor service area is well-defined and clearly marked.

(d) The on-premises licensee does not sell or allow the consumption of alcoholic liquor outdoors, except in the defined area described in subdivision (c).
