HOUSE BILL No. 5717

 

 

March 13, 2018, Introduced by Rep. Chatfield and referred to the Committee on Regulatory Reform.

 

     A bill to amend 2006 PA 110, entitled

 

"Michigan zoning enabling act,"

 

by amending section 210 (MCL 125.3210).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 210. Except as otherwise provided under this act, an

 

ordinance adopted under this act shall be is controlling in the

 

case of any inconsistencies between the ordinance and an ordinance

 

adopted under the local unit of government's general police powers

 

or any other law. Regulation of land by geographic area as

 

described in section 201 shall be provided for by an ordinance

 

adopted under this act and not by an ordinance adopted under the

 

local unit of government's general police powers.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
