A bill to amend 1964 PA 283, entitled
"Weights and measures act,"
by amending sections 10a and 10b (MCL 290.610a and 290.610b), as
amended by 2012 PA 254.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 10a. (1) A fee shall not be charged for the regular
2 inspection of any weights and measures or commodity subject to
3 this act. A fee shall be charged to the owner of or party
4 responsible party of for
any weights and measures or commodity
5 subject to this act in accordance with the schedule of inspection
6 fees provided in subsection (2) under either of the following
7 circumstances:
8 (a) The inspection is a reinspection of any weights and
9 measures or a lot sample of a commodity subject to this act that
1 has been tested and found incorrect.
2 (b) The inspection is performed at the request of the owner
3 or responsible party.
4 (2) The director shall establish the fees and expenses for
5 special services, including fees for voluntary registration and
6 type evaluation.charge

15 Linear measure – laboratory hourly rate $ 145.00
16 Counter or field weights hourly rate $ 100.00
17 Railroad hourly rate $ 100.00
18 Belt conveyor hourly rate $ 100.00
19 Mass flow meter hourly rate $ 100.00
20 (3) Money collected by the department under this act for
21 special services, fees, and civil fines shall be paid into the
22 general fund and credited to the department for weights and
23 measures programs.

Sec. 10b. (1) The department
may annually adjust the
25 schedule of fees for reinspections, voluntary registrations, type
26 evaluations, special weights and measures inspections, and other
27 special services requested of the department to provide that each
28 category of fee charged is sufficient to cover the cost of the
1 activities and that the aggregate of fees collected is sufficient
2 to pay for all salaries and other expenses connected with the
3 activities described in this subsection.
4 (2) Except as
otherwise provided by law, if an owner or
5 operator of weights and measures that are is assessed
an
6 administrative fine, civil fine, or a fee as described in this
7 section or section 10a, or any combination of administrative
8 fine, civil fine, or fee, who and does not pay the administrative
9 fine, civil fine, or fee amount
assessed within 60 days after
10 written notice of the assessment is sent, may be subject to the
11
director may issue a stop use order ,
issued by the director, for
12 those weights and measures.
