HOUSE BILL NO. 5597

March 05, 2020, Introduced by Reps. Garza, Anthony, Robinson, Guerra, Garrett, Love, Shannon, Tyrone Carter, Hope, Brixie, Hood, Kennedy, Stone, Manoogian and Jones and referred to the Committee on Government Operations.

A bill to prohibit an owner or operator of a multiunit residence from denying access to the residence by a federal census employee; and to require the owner or operator to allow the distribution of census materials by the employee.

the people of the state of michigan enact:

Sec. 1. As used in this act:

(a) "Federal census employee" means an employee of the United States Department of Commerce, Bureau of the Census.

(b) "Multiunit residence" means an apartment building, dormitory, nursing home, mobile home park, other multiple unit facility used as a residence, or an area in which 2 or more single-family dwellings are located on private roadways.

(c) "Nursing home" means that term as defined in section 20109 of the public health code, 1978 PA 368, MCL 333.20109.

Sec. 3. An owner or operator of a multiunit residence shall not directly or indirectly deny access to that residence by a federal census employee who displays a valid census credential and who is engaged in official census business. The owner or operator shall permit the employee to leave census materials for residents at their doors, except that the manager of a nursing home may direct that the materials be left at a central location within the facility. The materials must be left in an orderly manner.

Sec. 5. This act does not prohibit any of the following:

(a) Denial of admittance into a particular apartment, room, mobile home, or personal residential unit.

(b) In the case of a nursing home, denial of permission to visit certain persons for valid health reasons.

(c) Limiting visits to a reasonable number of census employees or reasonable hours.

(d) Requiring a prior appointment to gain access to the facility.

(e) Denial of admittance to or expulsion of an individual employee from a multiunit residence for good cause.

Sec. 7. An owner or operator of a multiunit residence that is in compliance with 13 USC 223, and any guidance or rules adopted by the United States Department of Commerce, Bureau of the Census, governing access to a multiunit residence is considered to be in compliance with the requirements of this act.
