HOUSE BILL NO. 5544

February 25, 2020, Introduced by Reps. Wakeman and Marino and referred to the Committee on Regulatory Reform.

A bill to amend 1998 PA 58, entitled

"Michigan liquor control code of 1998,"

(MCL 436.1101 to 436.2303) by adding section 204b.

the people of the state of michigan enact:

Sec. 204b. An on-premises licensee shall not allow on the licensed premises a machine that dispenses beer or wine directly to a customer unless all of the following conditions are met:

(a) The dispensing machine is located at the licensed premises.

(b) Subject to subdivision (c), the dispensing machine does not dispense more than 32 ounces of beer or 10 ounces of wine in a single order.

(c) If approved by the server, the dispensing machine does not dispense more than 48 ounces of beer or 15 ounces of wine in a single order.

(d) The dispensing machine does not dispense spirits or mixed spirit drink.

(e) The patron of the establishment orders the beer or wine from a clerk, agent, or employee of the licensee.

(f) The licensee does not sell, offer to sell, or advertise the sale of an unlimited quantity of beer or wine from the dispensing machine.

(g) The licensee monitors the sale, service, and consumption of beer or wine from the dispensing machine to ensure compliance with this act and the rules promulgated under this act.
