A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 81f.

the people of the state of michigan enact:

Sec. 81f. (1) An individual who assaults, batters, wounds, or endangers a school employee, school contractor, member of a board of a public school or nonpublic school, member of the board of directors of a public school academy, or member of an intermediate school board who the individual knows or has reason to know is performing his or her duties as a school employee, school contractor, member of a board of a public school or nonpublic school, member of the board of directors of a public school academy, or member of an intermediate school board is guilty of a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $1,000.00, or both.

(2) As used in this section:

(a) "Intermediate school board" means that term as defined in section 4 of the revised school code, 1976 PA 451, MCL 380.4.

(b) "Nonpublic school" means that term as defined in section 5 of the revised school code, 1976 PA 451, MCL 380.5.

(c) "Public school" means that term as defined in section 5 of the revised school code, 1976 PA 451, MCL 380.5.

(d) "Public school academy" means that term as defined in section 5 of the revised school code, 1976 PA 451, MCL 380.5.

(e) "School employee" means an individual who works at a public school or nonpublic school.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
