A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1247.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1247. (1) The Michigan teacher council is created in the
department.
(2) The Michigan teacher council shall consist of the
following members:
(a) Two members who are participating in a higher education
teacher preparation program, appointed by the governor.
(b) Four members who are public school teachers in this state,
appointed as follows:
(i) One member appointed by the majority leader of the senate.
(ii) One member appointed by the speaker of the house of
representatives.
(iii) One member appointed by the minority leader of the
senate.
(iv) One member appointed by the minority leader of the house
of representatives.
(c) One member appointed by the superintendent of public
instruction from a list of 3 or more prospective members submitted
by the Michigan Education Association.
(d) One member appointed by the superintendent of public
instruction from a list of 3 or more prospective members submitted
by the American Federation of Teachers.
(e) Three members appointed by the state board as follows:
(i) One member who is a representative of a school management
organization.
(ii) One member who is a representative from a nonprofit
organization that engages in teacher and education research.
(iii) One member who is a superintendent of a school district.
(3) The members first appointed to the Michigan teacher
council shall be appointed within 90 days after the effective date
of the amendatory act that added this section.
(4) Members of the Michigan teacher council shall serve for
terms of 4 years or until a successor is appointed, whichever is
later, except that of the members first appointed 5 shall serve for
1 year, 5 shall serve for 2 years, and 1 shall serve for 3 years.
(5) If a vacancy occurs on the Michigan teacher council, an
appointment for the unexpired term shall be made in the same manner
as the original appointment.
(6) The first meeting of the Michigan teacher council shall be
called by the superintendent of public instruction. At the first
meeting, the Michigan teacher council shall elect from among its
members a chairperson and other officers as it considers necessary
or appropriate. After the first meeting, the Michigan teacher
council shall meet at least quarterly, or more frequently at the
call of the chairperson or if requested by at least a majority of
members.
(7) A majority of the members of the Michigan teacher council
constitute a quorum for the transaction of business at a meeting of
the Michigan teacher council. A majority of the members present and
serving are required for official action of the Michigan teacher
council.
(8) The business that the Michigan teacher council may perform
shall be conducted at a public meeting of the Michigan teacher
council held in compliance with the open meetings act, 1976 PA 267,
MCL 15.261 to 15.275.
(9) A writing prepared, owned, used, in the possession of, or
retained by the Michigan teacher council in the performance of an
official function is subject to the freedom of information act,
1976 PA 442, MCL 15.231 to 15.246.
(10) Members of the Michigan teacher council shall serve
without compensation. However, members of the Michigan teacher
council may be reimbursed for their actual and necessary expenses
incurred in the performance of their official duties as members of
the Michigan teacher council.
(11) The Michigan teacher council shall provide all of the
following:
(a) Feedback to the superintendent of public instruction, the
state board, and the legislature on initiatives that it considers
critical to the development of attracting, preparing, and retaining
teachers.
(b) Guidance on best practices for developing the profession
of teaching, including, but not limited to, effective preparation
and compensation, and for creating the best teacher infrastructure
to serve this state.
(c) Advice to the governor and the legislature on subjects
regarding public education, including, but not limited to, building
a model for increasing teacher compensation, rewarding teachers for
exemplary service, making the teaching profession an attractive
option for prospective educators, and instituting practices that
help retain quality teachers in the classroom.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
