A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding part 4.
the people of the state of michigan enact:
PART 4 CORPORATE OFFICER LIABILITY
Sec. 401. Notwithstanding any other provision of this act, if a corporation is strictly liable for a criminal or civil violation of this act, an individual who had authority to exercise control over the act or omission of the corporation that resulted in the violation is also strictly liable for the violation, regardless of whether the individual exercised this authority or the corporation expressly vested a duty in the individual to oversee the act or omission.
