HOUSE BILL No. 5213

 

 

November 1, 2017, Introduced by Reps. Neeley, Moss, Greig, Hertel, Gay-Dagnogo, Faris, Sowerby, Wittenberg, Geiss, Pagan, Elder, Ellison, Chang, Sabo, Lasinski, Love, Hammoud and Zemke and referred to the Committee on Elections and Ethics.

 

     A bill to amend 1954 PA 116, entitled

 

"Michigan election law,"

 

(MCL 168.1 to 168.992) by adding sections 484a and 956a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 484a. (1) If an organization employs 1 or more

 

individuals as paid signature gatherers to obtain signatures for a

 

ballot question petition proposing a constitutional amendment,

 

initiation of legislation, or referendum of legislation, that

 

organization shall do both of the following:

 

     (a) Register the organization with the secretary of state.

 

     (b) Maintain a record of each individual employed by that

 


organization as a paid signature gatherer.

 

     (2) The secretary of state may request at any time that an

 

organization described in subsection (1) provide to the secretary

 

of state a copy of the record of each individual employed by that

 

organization as a paid signature gatherer.

 

     (3) If an organization described in subsection (1) fails or is

 

unable to provide to the secretary of state a record of each

 

individual employed by that organization as a paid signature

 

gatherer, the organization is subject to a civil fine as follows:

 

     (a) For a first violation, a civil fine of $5,000.00.

 

     (b) For a second violation, a civil fine of $7,500.00.

 

     (c) For a third or subsequent violation, a civil fine of

 

$10,000.00.

 

     Sec. 956a. (1) If an organization employs 1 or more

 

individuals as paid signature gatherers to obtain signatures for a

 

recall petition, that organization shall do both of the following:

 

     (a) Register the organization with the secretary of state.

 

     (b) Maintain a record of each individual employed by that

 

organization as a paid signature gatherer.

 

     (2) The secretary of state may request at any time that an

 

organization described in subsection (1) provide to the secretary

 

of state a copy of the record of each individual employed by that

 

organization as a paid signature gatherer.

 

     (3) If an organization described in subsection (1) fails or is

 

unable to provide to the secretary of state a record of each

 

individual employed by that organization as a paid signature

 

gatherer, the organization is subject to a civil fine as follows:


     (a) For a first violation, a civil fine of $5,000.00.

 

     (b) For a second violation, a civil fine of $7,500.00.

 

     (c) For a third or subsequent violation, a civil fine of

 

$10,000.00.
