HOUSE BILL NO. 5209

A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

(MCL 257.1 to 257.923) by adding section 217j.

the people of the state of michigan enact:

Sec. 217j. (1) A county, by ordinance, may require the registration of each horse-drawn vehicle owned by an individual who resides in that county. A county that enacts an ordinance described in this subsection shall bear the cost of accepting applications for and issuing the registration certificates described in subsection (3). An individual shall not operate a horse-drawn vehicle in a county described in this subsection without first obtaining a registration certificate as provided in this section.

(2) If the county in which the owner of a horse-drawn vehicle resides has enacted an ordinance described in subsection (1), the owner shall apply to the county in which he or she resides, upon an appropriate form furnished by the county, for the registration of the horse-drawn vehicle. A county that has enacted an ordinance described in subsection (1) may charge a fee for the registration of a horse-drawn vehicle. A fee charged under this subsection must not exceed an amount considered necessary by the county to cover the cost of implementing the ordinance.

(3) A county that has enacted an ordinance described in subsection (1) shall issue a registration certificate upon receipt of the application described in subsection (2). The certificate must contain on its face the date issued, the name and address of the owner, the registration number assigned to the horse-drawn vehicle, and a description of the horse-drawn vehicle as determined by the county.

(4) A registration issued under this section does not expire until the owner of the horse-drawn vehicle transfers or assigns his or her interest in the horse-drawn vehicle.

(5) A registration certificate issued under this section must at all times be carried in the vehicle to which it refers or must be carried by the individual driving or in control of the horse-drawn vehicle, who shall display a copy of the registration certificate upon demand of a police officer.

(6) An individual who violates this section is responsible for a civil infraction.

(7) A county that has enacted an ordinance described in subsection (1) shall publish and make available to the public a horse and buggy driver manual that includes information on the requirements under this section.

(8) As used in this section, "horse-drawn vehicle" means a nonmotorized vehicle powered by an animal within the equine family.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
