HOUSE BILL No. 5069

 

June 9, 2009, Introduced by Reps. Spade, Durhal, Espinoza, Lahti, Bennett, McDowell, Polidori, Gonzales and Dean and referred to the Committee on Judiciary.

 

     A bill to amend 1961 PA 236, entitled

 

"Revised judicature act of 1961,"

 

(MCL 600.101 to 600.9947) by adding section 5705.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5705. If the plaintiff in summary proceedings under this

 

chapter is a sole proprietorship, partnership, corporation, limited

 

liability company, or other business organization, the proceedings

 

may be commenced or prosecuted by 1 or more of the following acting

 

on behalf of the plaintiff if the individual has direct and

 

personal knowledge of the facts surrounding the proceedings:

 

     (a) An employee or agent of the plaintiff.

 

     (b) If the plaintiff is a partnership, a partner.

 

     (c) If the plaintiff is a corporation, an officer.

 


     (d) If the plaintiff is a limited liability company, a member.
