HOUSE BILL No. 4995

September 20, 2017, Introduced by Rep. Kosowski and referred to the Committee on Families, Children, and Seniors.

A bill to amend 1981 PA 180, entitled

"Older Michiganians act,"

(MCL 400.581 to 400.594) by adding section 6l.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

Sec. 6l. (1) The aging and adult services agency shall collect

data on elder abuse possessed by state and local agencies,

including, but not limited to, the department of attorney general,

the Michigan domestic and sexual violence prevention and treatment

board, and the department of health and human services, for the

purpose of identifying the incidence of elder abuse among older

persons. The aging and adult services agency shall create an

interagency reporting system that contains a uniform set of

standards to collect and analyze this data. The aging and adult

services agency shall establish a definition for elder abuse, and

the minimum age of an older person, that enables the aging and

adult services agency to accurately compare similar data from

different state and local agencies. For the purposes of this

subsection, the aging and adult services agency, in establishing

the definition of elder abuse, may incorporate the different types

of physical, sexual, and emotional abuse, active and passive

neglect, and financial exploitation.

     (2) County and city human services agencies, adult protective

services agencies, and other community organizations that provide

services to older persons shall report incidences of elder abuse,

as defined by the aging and adult services agency, to that agency

in the format specified by the aging and adult services agency. The

information must contain, but is not limited to, the number of

referrals, investigations, and substantiated cases and demographic

information on victims and perpetrators.

     (3) The aging and adult services agency shall issue a report

to the governor, the majority leader of the senate, the speaker of

the house of representatives, the minority leader of the senate,

and the minority leader of the house of representatives, on or

before March 1 in odd-numbered years. The report shall outline the

aging and adult services agency's recommendations for defining the

term "elder abuse" in statute, the types of reporting requirements

that shall be instituted to prevent the incidence of elder abuse,

and the programs available to prevent elder abuse and to provide

services to victims of elder abuse.

Enacting section 1. This amendatory act takes effect 90 days

after the date it is enacted into law.
