June 8, 2017, Introduced by Reps. Howrylak, Inman, Zemke, Gay-Dagnogo, Lucido, Pagel and Robinson and referred to the Committee on Law and Justice.

 

     A bill to amend 1953 PA 232, entitled

 

"Corrections code of 1953,"

 

(MCL 791.201 to 791.285) by adding section 64a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 64a. (1) By October 1, 2017, the department shall develop

 

policies to ensure that an inmate, including an inmate in punitive

 

or administrative segregation, who is less than 21 years of age is

 

offered age-appropriate out-of-cell programming and outdoor

 

exercise not less than 5 days a week.

 

     (2) By January 1, 2018, the department shall develop policies

 

to ensure that an inmate, including an inmate in punitive or

 

administrative segregation, who is less than 21 years of age is

 

released from his or her cell each day. The policies developed by

 

the department under this subsection must be based on the

 


guidelines for the use of restraint and seclusion established under

 

sections 740 and 742 of the mental health code, 1974 PA 258, MCL

 

330.1740 and 330.1742.
