SUBSTITUTE FOR

 

HOUSE BILL NO. 4590

 

 

 

 

 

 

 

 

 

 

 

     A bill to amend 1931 PA 328, entitled

 

"The Michigan penal code,"

 

(MCL 750.1 to 750.568) by adding section 479d.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 479d. (1) A person who commits or attempts to commit a

 

violent felony in which the victim is targeted because he or she

 

is, or is perceived to be, a law enforcement officer or corrections

 

officer is guilty of a felony punishable by imprisonment for not

 

more than 2 years, to be served consecutively to any term of

 

imprisonment imposed for the underlying felony or attempted felony.

 

     (2) As used in this section:

 

     (a) "Corrections officer" means that term as defined in

 

section 316.

 

     (b) "Law enforcement officer" means that term as defined in

 


section 2 of the Michigan commission on law enforcement standards

 

act, 1965 PA 203, MCL 28.602.

 

     (c) "Violent felony" means an offense against a person in

 

violation of section 82, 83, 84, 85, 86, 87, 88, 89, 316, 317, 321,

 

349, 349a, 350, 397, 520b, 520c, 520d, 520e, 520g, 529, 529a, or

 

530 of the Michigan penal code, 1931 PA 328, MCL 750.82, 750.83,

 

750.84, 750.85, 750.86, 750.87, 750.88, 750.89, 750.316, 750.317,

 

750.321, 750.349, 750.349a, 750.350, 750.397, 750.520b, 750.520c,

 

750.520d, 750.520e, 750.520g, 750.529, 750.529a, and 750.530.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless House Bill No. 4585 of the 99th Legislature is enacted into

 

law.
