HOUSE BILL No. 4334

     A bill to amend 1976 PA 451, entitled

 

"The revised school code,"

 

(MCL 380.1 to 380.1852) by adding section 1178b; and to repeal acts

 

and parts of acts.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1178b. (1) The board of a school district or intermediate

 

school district or board of directors of a public school academy

 

shall ensure that a first aid response kit is installed and

 

maintained in each school building operated by the school district,

 

intermediate school district, or public school academy. The first

 

aid response kit must include at least all of the following:

 

     (a) A tourniquet.

 

     (b) Bleeding control dressings.

 

     (c) Compression bandages.

 


     (d) Instructions on the use of the first aid response kit

 

developed by the Stop the Bleed program or the American College of

 

Surgeons Committee on Trauma or other instructions determined

 

appropriate by the department.

 

     (e) Protective gloves.

 

     (f) A marker.

 

     (2) The board of a school district or intermediate school

 

district or board of directors of a public school academy shall

 

ensure that all staff members of the school district, intermediate

 

school district, or public school academy are trained on the use

 

and maintenance of the first aid response kit installed under

 

subsection (1).

 

     (3) A school administrator, teacher, or other school employee

 

designated by the school administrator, who in good faith uses a

 

first aid response kit in an emergency that threatens the life or

 

health of a pupil is not liable in a criminal action or for civil

 

damages as a result of an act or omission in the use of the first

 

aid response kit, except for an act or omission amounting to gross

 

negligence or willful and wanton misconduct.

 

     (4) As used in this section, "school building" means any of

 

the following:

 

     (a) A building intended to be used to provide instruction for

 

pupils, including an addition to an existing building.

 

     (b) A recreational or athletic structure or field intended to

 

be used by pupils.

 

     Enacting section 1. Section 1178b of the revised school code,

 

1976 PA 451, as added by this amendatory act, is repealed effective


January 1, 2023.

 

     Enacting section 2. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
