HOUSE BILL NO. 4104
A bill to require certain individuals to obtain the consent of a parent, guardian, or person acting in loco parentis of the individual before exercising a right described in section 28 of article I of the state constitution of 1963.
the people of the state of michigan enact:
Sec. 1. (1) Except as otherwise provided in subsection (2), if an individual is less than 16 years old, the individual shall not exercise a right described in section 28 of article I of the state constitution of 1963 without first obtaining the consent of a parent, guardian, or other person acting in loco parentis of the individual.
(2) An individual who is less than 16 years old may exercise a right described in section 28 of article I of the state constitution of 1963 without first obtaining the consent of a parent, guardian, or other person acting in loco parentis of the individual, if any of the following apply:
(a) The individual is emancipated.
(b) The individual is lawfully consenting to the exercise of the right in accordance with section 9132 of the public health code, 1978 PA 368, MCL 333.9132, or in accordance with any other law in which the individual's consent is valid and binding as if the individual achieved the age of majority.
(c) If consent is waived under the parental rights restoration act, 1990 PA 211, MCL 722.901 to 722.908.
