SENATE RESOLUTION

MADAM PRESIDENT:

I offer the following resolution and move its adoption:

A SENATE RESOLUTION requesting the Unemployment Insurance Oversight Commission study the management of the New Hire database.

    Whereas, Federal and State law requires employers to report newly hired and re-hired employees in Indiana to the Indiana New Hire Reporting Center;

    Whereas, The 1996 federal welfare reform legislation created the requirement for employers in all 50 states to report their new hires and re- hires to a state directory;

    Whereas, Indiana law requires all employers to submit their new hire reports within 20 days after the employee is hired or re- hired or returns to work;

    Whereas, The state of Indiana has contracted to establish the Indiana New Hire Reporting Center, which is jointly managed by the Department of Child Services (DCS) and the Department of Workforce Development (DWD);

    Whereas, t he new hires data base is used by DCS to facilitate the child support income withholding order

process, expedite the collection of child support from parents who change jobs frequently, and quickly locate non- custodial parents to help in establishing paternity and child support orders;

    Whereas, According to DCS, there is no information on how many employers are submitting timely information and there is no penalty for employers who are not submitting timely information;

    Whereas, The United States Department of Labor attributes 18% of Indiana 's overpayments on unemployment insurance benefits as going to individuals who have already found work; and

    Whereas, There is a potential loss in revenue to the state in terms of unemployment insurance payments going to individuals who are no longer eligible due to employment status: therefore,

Be it resolved by the Senate of the

General Assembly of the State of Indiana:

SECTION 1. That the Unemployment Insurance Oversight Committee is requested to study the management of the New Hire database and employer compliance with reporting requirements.
