Synopsis: Charter school approval process. Provides that before a
sponsor may issue a charter for a new charter school that is located in
a school corporation in which at least 50% of the public school students
attend charter schools, the sponsor must request approval from the
governing body of the school corporation to issue the charter. Requires
the governing body to consider the benefits to students of allowing the
proposed charter school and the impact of the charter school on the
school corporation before approving or denying the request. Provides
that if the request is denied, the sponsor may not issue a charter for the
proposed charter school.
Effective: July 1, 2013.

(b) Before issuing a charter for a new charter school that is located within the boundaries of the school corporation, the sponsor must request the approval of the governing body of the school corporation to issue the charter. After considering the benefits to the students of the school corporation of allowing the proposed charter school to open and the impact of the proposed charter school on the school corporation, the governing body shall approve or deny the sponsor's request. If the request is denied, the sponsor may not issue a charter for the proposed charter school.
