Chapter 43. School Influenza Vaccination Program
Sec. 1. (a) Subject to available funding, the state department shall establish a school based influenza vaccination pilot program.
(b) The pilot program must provide for the following:
(1) The pilot program will be implemented by the state department for the 2010-2011 influenza season.
(2) Participation by a school corporation (as defined in IC 20-18-2-16) must be voluntary.
(3) Before a student is vaccinated, consent must be obtained from the student's parent or legal guardian.
(c) In conducting the pilot program under this chapter, the state department shall maximize the use of influenza vaccine through the federal Centers for Disease Control and Prevention's Vaccines for Children Program and any other federal and state resources that
provide influenza vaccine.
Sec. 2. The state department may seek, receive, and spend any
grant, appropriation, donation, or reimbursement from any public
or private source to implement the pilot program under this
chapter.
Sec. 3. (a) Before August 1, 2011, the state department shall do
the following:
(1) Evaluate the school based influenza vaccination pilot
program established under this chapter and prepare a written
report setting forth the state department's findings and
recommendations concerning the pilot program.
(2) Present the written report to the governor, the legislative
council, and the health finance commission established by
IC 2-5-23-3.
The report submitted to the legislative council under subdivision
(2) must be in an electronic format under IC 5-14-6.
(b) The report must include the following:
(1) An assessment of the benefits of establishing school based
influenza vaccination programs.
(2) The identification of barriers to implementing school
based influenza vaccination programs and recommendations
for removing or mitigating the barriers.
Sec. 4. This chapter expires July 1, 2012.
