Synopsis: Environmental air permits. Requires the air pollution control board to adopt rules for a facility that generates public electric power: (1) to require, in the construction or operation permit review, the reporting and use of emissions of air contaminants from internal combustion engines used for on site and off site transportation that supports the facility; and (2) to require the construction or operation permit applicant for the facility to supply complete information when the application is filed.

SENATE BILL No. 284



    A BILL FOR AN ACT to amend the Indiana Code concerning environmental law.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 13-17-3-16; (10)IN0284.1.1. -->     SECTION 1. IC 13-17-3-16 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 16. (a) This section applies to a facility:
        (1) that generates electric power, some or all of which is supplied to a grid that supplies electric power to the public; and
        (2) that for purposes of obtaining a permit under this title for construction or operation of the facility is required to report emissions of air contaminants.
    (b) The board shall adopt rules under IC 4-22-2 and IC 13-14-9 that:
        (1) require a facility described in subsection (a) to include in emissions reports described in subsection (a)(2) emissions of air contaminants from internal combustion engines used for on site and off site transportation that supports the construction or operation of the facility; and
        (2) require the department to use emissions reported as

required in subdivision (1) in all aspects of the process for permit review, issuance, and renewal in which the level of emissions of air contaminants from the facility is considered.

(a) This section applies to a facility that generates electric power, some or all of which is supplied to a grid that supplies electric power to the public.
    (b) The board shall adopt rules under IC 4-22-2 and IC 13-14-9 that:
        (1) prohibit the issuance or renewal of a permit
for construction or operation of a facility described in subsection (a) if the application for issuance or renewal does not include all of the information that the department requires to be included in the application; and
        (2) prohibit as a substitution for complete inclusion of information as described in subdivision (1) a statement to the effect that information will be supplied after the application is filed with the department.
