A BILL FOR AN ACT to amend the Indiana Code concerning
human services.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 12-7-2-34, AS AMENDED BY P.L.1-2007,
SECTION 105, IS AMENDED TO READ AS FOLLOWS

following:
(1) For purposes of IC 12-10-2, the meaning set forth in
IC 12-10-2-1.

SECTION 2. IC 12-7-2-37.5 IS ADDED TO THE INDIANA CODE

purposes of IC 12-10-2.5, has the meaning set forth in
IC 12-10-2.5-2.

SECTION 3. IC 12-10-2.5 IS ADDED TO THE INDIANA CODE
AS A
NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
UPON PASSAGE]:
Chapter 2.5. Hoosier Commission for Communities for a
Lifetime
Sec. 1. As used in this chapter, "commission" refers to the
Hoosier commission for communities for a lifetime established by
section 3 of this chapter.
Sec. 2. As used in this chapter, "community for a lifetime"
refers to a community where residents work together in holistic
and multidisciplinary ways to allow residents to:
(1) organize and become involved in the community;
(2) decide collectively on the priorities for the community;
and
(3) act on the priorities to implement change in the
community.
Sec. 3. (a) The Hoosier commission for communities for a
lifetime is established to report to the general assembly with
recommendations on the following:
(1) A process for a community to request and receive the
designation of Hoosier community for a lifetime.
(2) The resources needed, from all sectors, to:
(A) initiate planning; and
(B) implement plans;
in a community to become a community for a lifetime.
(b) The commission consists of the following members to be
appointed for a term ending December 31, 2012:
(1) The executive director of the Indiana housing and
community development authority created by IC 5-20-1-3, or
the executive director's designee, who shall serve as the
chairperson of the commission.
(2) The director of the division of aging established by
IC 12-9.1-1-1, or the director's designee.
(3) Two (2) city officials, to be appointed as follows:
(A) One (1) city official to be appointed by the minority
leader of the senate.
(B) One (1) city official to be appointed by the speaker of
the house of representatives.
(4) Two (2) county officials, to be appointed as follows:
(A) One (1) county official to be appointed by the president
pro tempore of the senate.
(B) One (1) county official to be appointed by the minority
leader of the house of representatives.
(5) Four (4) representative from area agencies on the aging,
to be appointed as follows:
(A) One (1) representative to be appointed by the president
pro tempore of the senate.
(B) One (1) representative to be appointed by the minority
leader of the senate.
(C) One (1) representative to be appointed by the speaker
of the house of representatives.
(D) One (1) representative to be appointed by the minority
leader of the house of representatives.
(6) Two (2) health care representatives, to be appointed as
follows:
(A) One (1) individual to be appointed by the speaker of
the house of representatives.
(B) One (1) individual to be appointed by the president pro
tempore of the senate.
(7) Two (2) representative from universities, to be appointed
as follows:
(A) One (1) individual to be appointed by the minority
leader of the senate.
(B) One (1) individual to be appointed by the minority
leader of the house of representatives.
(8) One (1) member who is:
(A) a member of a minority group (as defined in
IC 4-13-16.5-1(j)); and
(B) a representative of a health care provider;
to be appointed by the governor.
(9) One (1) representative of an agency involved in planning,
housing, and economic development, to be appointed by the
governor.
(10) One (1) representative from the business community, to
be appointed by the governor.
(11) One (1) member of the senate, to be appointed by the
president pro tempore of the senate.
(12) One (1) member of the senate, to be appointed by the
minority leader of the senate.
(13) One (1) member of the house of representatives, to be
appointed by the speaker of the house of representatives.
(14) One (1) member of the house of representatives, to be
appointed by the minority leader of the house of
representatives.
(15) One (1) Indiana resident who:
(A) is not more than fifty-nine (59) years of age; and
(B) has a disability;
to be appointed by the president pro tempore of the senate.
(16) One (1) Indiana resident who:
(A) is at least sixty-five (65) years of age; and
(B) represents an aging advocacy organization;
to be appointed by the speaker of the house of representatives.
(17) One (1) representative of the Indiana community
foundation network, to be appointed by the governor.
(c) The commission shall be staffed by the Indiana housing and
community development authority. Expenses of the commission
shall be paid from appropriations made to the Indiana housing and
community development authority.
Sec. 4. A member of the commission is not entitled to per diem
or travel expenses incurred in attending commission meetings.
Sec. 5. The affirmative votes of a majority of the voting
members appointed to the commission are required for the
commission to take action on any measure, including preliminary
and final reports.
Sec. 6. (a) When developing a plan for a community to become
a community for a lifetime, the commission shall consider the
following criteria:
(1) Affordable housing.
(2) Housing that is modified and constructed to accommodate
mobility issues and safety.
(3) Livability and safety, including a walkable environment
and complete streets.
(4) Access to nutritious food.
(5) Access to economic and wealth building opportunities.
(6) Home care and personal assistance services that residents
know how to obtain.
(7) Available retail services.
(8) Access to preventive health care.
(9) Opportunities for physical activity.
(10) Access to medical care.
(11) Access to affordable transportation.
(12) Available community services system.
(13) Mobilized caregivers to complement the formal service
system.
(14) Access to quality community or senior centers, nursing
homes, assisted living facilities, adult day care, and adult
foster care.
(15) Promotion of social and civic engagement.
(16) Access to meaningful relationships with children and
youth in the community.
(b) The commission shall consult with the Indiana Institute on
Disability and Community's Center on Aging and Community to
achieve the goals of the commission.
Sec. 7. A community for a lifetime must do the following:
(1) Involve partnerships among the state, regions, counties,
municipalities, cities, and towns where citizens seek to
affirmatively provide a high quality of life for all residents
and extend the opportunities, support, and services that will
enable citizens to grow older in a community of choice and to
continue to be contributing, civically engaged residents.
(2) Incorporate widespread citizen participation methods into
the local planning process.
(3) Establish an ongoing local commission to advise the
community on the opportunities, services, and supports
required by the citizens.
(4) Incorporate into the local plan elements addressing the
impact of changes in population demographics, including age,
land use, housing, public facilities, transportation, and capital
improvement.
(5) Develop strategies to develop infrastructure needed for the
projected population.
Sec. 8. The commission shall make a preliminary report to the
general assembly not later than November 1, 2011. The commission
shall make a final report to the general assembly not later than
November 1, 2012. The reports to the general assembly must be in
an electronic format under IC 5-14-6.
Sec. 9. This chapter expires December 31, 2012.
