Synopsis: Review of bid selection. Requires a state agency, if it awards a contract for a public work or improvement to a person other than the lowest bidder, to meet upon request with the lowest bidder and to discuss the lowest bidder's bid with the lowest bidder. Requires each state agency to develop a policy concerning such meetings.

HOUSE BILL No. 1218



    A BILL FOR AN ACT to amend the Indiana Code concerning state and local administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 5-16-2-4; (10)IN1218.1.1. -->     SECTION 1. IC 5-16-2-4 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2010]: Sec. 4. (a) As used in this section, "state agency" has the meaning set forth in IC 4-13.5-1-1(10).
    (b) If a state agency awards a contract for a public work or improvement to a person submitting a bid other than the lowest bid, the person submitting the lowest bid may, within seven (7) days after the announcement of the awarding of the contract, request a meeting with the state agency.

     (c) Within seven (7) days after receiving a request for a meeting under subsection (b), the state agency shall meet with the person who submitted the lowest bid to give that person the opportunity to discuss that person's bid. The state agency shall provide to that person, in writing, the agency's reasons for accepting a bid that was higher than that person's bid.
    (d) Each state agency must develop a policy (as defined in IC 5-22-2-21) for meetings under this section with the lowest

bidder on a contract for a public work or improvement. The procedures established by a policy developed under this subsection are not administrative hearing procedures subject to IC 4-21.5.
